Response to Governor LePages Answer to the Remonstrance

Postby xjdigger » Tue Oct 01, 2013 10:46 am

The Answer from Governor Paul LePage was suppose to be in response to the issue presented to him that the Courts, Lawyers and Judges were unlawful according to the Maine Constitution. He ignored the original question and handed us this answer that the Remonstrance was a right to the citizen but Government had no authority to answer complaint from the citizen.

The Maine Remonstrance is a grievance process ordained by the People of Maine to seek Redress of unconstitutional activities and violations by the public servants representing the People they serve.

A constitution of Maine was established in 1820 as the Law of Maine that organized a government system. Maine was organized as a free and independent state under the authority of the people. The Preamble sets the stage of the Constitution of Maine in which “We the People of Maine” established the Constitution for a free and independent State of Maine as identified in the Preamble.

We the people of Maine, in order to establish justice, insure tranquility, provide for our mutual defense, promote our common welfare, and secure to our selves and our posterity the blessings of liberty, acknowledging with grateful hearts the goodness of the Sovereign Ruler of the Universe in affording us an opportunity, so favorable to the design; and, imploring His aid and direction in its accomplishment, do agree to form ourselves into a free and independent State by the style and title of the State of Maine, and do ordain and establish the following Constitution for the government of the same.

Article I. "Declaration of Rights" defines the rights of the people that is to be protected by the government of the State of Maine. There are many important sections in Article I that are to be understood by the people and the members of the government system to establish the justice, insure tranquility, provide for our mutual defense, promote our common welfare, and secure to our selves and our posterity the blessings of liberty.

The 1st law identifies the natural unalienable rights of the citizen including our rights to property.
- Section 1. Natural rights. “All people are born equally free and independent, and have certain natural, inherent and unalienable rights, among which are those of enjoying and defending life and liberty, acquiring, possessing and protecting property, and of pursuing and obtaining safety and happiness”.

The authority of the government of Maine is identified in the 2nd law, that We the People of Maine have the over riding authority over our Maine government system and hold the rights to give instruction to our government personnel or even alter reform or abolish the government if our safety and happiness dictates.

- Article 1 Section 2 “”Power inherent in people. “”All power is inherent in the people; all free governments are founded in their authority and instituted for their benefit; they have therefore an unalienable and indefeasible right to institute government, and to alter, reform, or totally change the same, when their safety and happiness require it.“”

* It is the responsibility and authority of the People to require that our public servants do their job according to the constitutional law of government. When the personnel of our governance system violate the constitution we the people have the remedy of Article 1 Section to to address the unconstitutional behavior. Our public servants are bound by the constitutional job description to respect our right to a grievances and answer to our complaints or they are violating their fiduciary duty to us.

- Maine Constitution Article 1 Section 15. Right of petition. The people have a right at all times in an orderly and peaceable manner to assemble to consult upon the common good, to give instructions to their representatives, and to request, of either department of the government by petition or remonstrance, redress of their wrongs and grievances.

The 1828 Webster dictionary defines Remonstrance. - “Expostulation; strong representation of reasons against a measure, either public or private, and when addressed to a public body, a prince or magistrate, it may be accompanied with a petition or supplication for the removal or prevention of some evil or inconvenience. A party aggrieved presents a remonstrance to the legislature.”

My analogy of Governor LePages final position of the Remonstrance from the Maine Citizen.

We had presented him information on the unlawful courts and Judges that hijacked the government in disavowing the natural inherent unalienable rights of the people of Maine that our government serves.

The Maine BAR Association holds and dictates all legal opinion of government operations which duty has never been bestowed by the Constitution of Maine. Carlisle McLean and Hank Fenton who are Maine BAR Association Lawyers dictated their opinion over the rights of the citizen to inform the governor that we have no standing to gain a proper redress of grievance as constitutionally mandated by the Maine Constitution.

Our Government has insulated themselves to be the rulers over the people with out constitutional recourse and it is time to assemble, consult upon common Good and institute a citizens Remonstrance with in mass to converge upon the State House of Augusta

Our only recourse now seems to be assembling a large group of Maine people to demonstrate our authority against the unconstitutional activities of our government system.
