Local Remonstrance

Postby xjdigger » Sat Feb 23, 2013 11:48 pm

A Remonstrance is not just a grievance process for the State but a duty of all citizens to get involved to instruct local community, county and state of wrongs and evils that needs to be corrected in all American forms of governance.

A Remonstrance is a constitutional Notice and Demand from the People to government officials at any level, to refrain from implementing, or the continued support of, unlawful legislative, administrative, or regulatory actions that infringe upon or violate the people's inherent rights - any or all of them, not just those mentioned/enumerated in the Constitution or Bill of Rights, but those which are protected by the 9th Amendment in the Constitution, too.
Black's Law Dictionary (6th Edition) defines it as: "Expostulation; showing of reasons against something proposed; a representation made to a court or legislative body wherein certain persons unite in urging that a contemplated measure be not adopted or passed. A formal protest against the policy or conduct of the government or of certain officials drawn up and presented by aggrieved citizens." (Emphasis added)
The Remonstrance must be a Notice addressed respectfully to those whom are to refrain from certain actions by a person or group of persons. It should be factual, precisely identifying the alleged unlawful action(s), the demanded remedy(ies) (e.g. cessation of prior actions, or refraining from the adoption of future ones). It should allow a specific time for the demanded response to be made, and signed by those persons making the demands with contact information included. The document should be presented by personal delivery, or at least by Registered mail (return receipt requested), and a signed and dated receipt obtained from an authorized official for the personal delivery.
There are many follow-up options available, depending on the actions of the officials who were served. Some of the possibilities are a Notice of Default, a Civil or Criminal Complaint, and/or a Commercial Lien process. The procedures for each follow-up action is quite specific, but if properly done, very effective.
