Maine Constitutional Law

Postby xjdigger » Fri Feb 22, 2013 8:39 pm

A constitution of Maine was established in 1820 as the Law of Maine that organized a government system. Maine was organized as a free and independent state under the authority of the people. The Preamble sets the stage of the Constitution of Maine in which “We the People of Maine” established the Constitution for a free and independent State of Maine as identified in the Preamble.

We the people of Maine, in order to establish justice, insure tranquility, provide for our mutual defense, promote our common welfare, and secure to our selves and our posterity the blessings of liberty, acknowledging with grateful hearts the goodness of the Sovereign Ruler of the Universe in affording us an opportunity, so favorable to the design; and, imploring His aid and direction in its accomplishment, do agree to form ourselves into a free and independent State by the style and title of the State of Maine, and do ordain and establish the following Constitution for the government of the same.

Article I. "Declaration of Rights" defines the rights of the people that is to be protected by the government of the State of Maine. There are many important sections in Article I that are to be understood by the people and the members of the government system to establish the justice, insure tranquility, provide for our mutual defense, promote our common welfare, and secure to our selves and our posterity the blessings of liberty.

The 1st law identifies the natural unalienable rights of the citizen including our rights to property.
- Section 1. Natural rights. All people are born equally free and independent, and have certain natural, inherent and unalienable rights, among which are those of enjoying and defending life and liberty, acquiring, possessing and protecting property, and of pursuing and obtaining safety and happiness”.

The authority of the government of Maine is identified in the 2nd law, that We the People of Maine have the over riding authority over our Maine government system and hold the rights to give instruction to our government personnel or even alter reform or abolish the government if our safety and happiness dictates.

- Article 1 Section 2 “”Power inherent in people. “”All power is inherent in the people; all free governments are founded in their authority and instituted for their benefit; they have therefore an unalienable and indefeasible right to institute government, and to alter, reform, or totally change the same, when their safety and happiness require it.“”

We The People of Maine” need to fix the problems of our Government system. It is our individual responsibility and authority to get involved in enforcing the Constitution that defines the laws and duties of our own state governance system. “We the People of Maine” have got to Stand up and take the Authority back and the politicians must listen and comply. We need to gather together for a citizen action response to an out of control government system and to protect us from the state of emergency our government has created.

The federal constitution does not hold any responsibility to American citizens it is an entity of the states control which authorized the Constitution for the United States of America. The rights of the citizens reside in the states to be upheld by the constitution

When we understand our rights, freedoms and duties identified in the law of the constitution, and then get into action to defend it we can take back Maine politics to respecting the citizen rights that is their oath and duties to defend and protect. It is time to stop playing their politics and start a new movement of citizen action by lawful and constitutional remedies.

The Constitution of the State of Maine dictates the authority and procedures of governance that is authorized by the people in the free and independent state of Maine. All government officials and personnel swear an oath to abide by this constitution. When the government personnel fail to operate by the dictates of the constitution, it is the remedy defined in the Maine constitution Article I Section 15 to present the wrongs and grievances and demand compliance to the laws rules and regulations described by the constitution that “We the People of Maine” ordained and established upon the creation of the governance system in Maine.

* Maine Constitution Article 1 Section 15. Right of petition. The people have a right at all times in an orderly and peaceable manner to assemble to consult upon the common good, to give instructions to their representatives, and to request, of either department of the government by petition or remonstrance, redress of their wrongs and grievances.

The 1828 Webster dictionary defines Remonstrance. - “Expostulation; strong representation of reasons against a measure, either public or private, and when addressed to a public body, a prince or magistrate, it may be accompanied with a petition or supplication for the removal or prevention of some evil or inconvenience. A party aggrieved presents a remonstrance to the legislature.”

We the People of Maine must devise a plan idea concentrated to Remonstrance. A group of us served the Remonstrance document on our government and requested a meeting with the Governor. Governor Paul LePage met with us first for 1.5 hours to receive our presentation of the wrongs and grievances of the unconstitutional operations of the Maine Governance System. Then he invited us back to present the unconstitutional acts against our private property rights presented by Michael Coffman, Roger Ek and Henry Joy. Governor Paul LePage was very respective on all issues but claimed his hands were tied by past legislation and the House and the senate.

Then we want to hold a Remonstrance on a Joint House and Senate session to inform our elected Officials of wrongs and grievances that is being performed by our governance system that violates the laws of the constitution set forth in the creation of the State of Maine ordained by “We the People of Maine”.

So far we have not had a response from the House of Representatives and the Senate who have been served this remonstrance. Now it is time for the people of Maine to get involved in making this a public campaign to get the attention of our politicians to understand the meaning and duties of their oaths to operate the governance system according to the constitutional law of the State of Maine.

This is our Government and we get the government we deserve. Just voting for a politician is not going to fix the problems we face. We must get involved to create a revolution in the way “We the People of Maine” deal with our government. Because we need a revolution in the way our government represents “We the People of Maine”
